What is Property Law?
Property law governs the rights, interests, and obligations that people have in respect of movable and immovable property. Property rights are protected by the Constitution of the Republic of South Africa, 1996, and regulated by both common law and various statutes, such as the Deeds Registries Act 47 of 1937 and the Sectional Titles Act 95 of 1986.
It covers
-
Ownership – full legal right to possess, use, enjoy, and dispose of property.
-
Limited real rights – such as servitudes, mortgage bonds, and usufructs.
-
Possession and occupation – including landlord–tenant relationships.
-
Transfer and registration of immovable property in the Deeds Office.
-
Property disputes – including boundary issues and rights of way.
